Please read these Terms and Conditions (‘Terms’, ‘Terms and Conditions’) carefully before using Rx (Prescription) Express Service mobile application (the ‘Service’, ‘Application’).

If you do not agree to these Terms, please do not access nor use Rx (Prescription) Express Service mobile application (the ‘Service’, ‘Application’). You should understand that by ordering any of our services, you agree to be bound by these Terms.

You should understand that ‘Rx Express Service’, is not an online pharmacy.

No medicinal products are sold online via the mobile application.

Rx Express Service is a service provider.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

You should print a copy of these Terms for future reference.

AGREEMENT

By using the Service you agree to be bound by these Terms and Conditions and authorise us to process information, including but not limited to, your personal details, name and surname, contact number, delivery address and uploaded medical prescription/s.

By using this Service, you warrant that:

PRIVACY POLICY

We will treat all your personal information as confidential. By using our Service, you consent to such processing and you warrant that all data provided by you is accurate.

When you opt for a Service, we will ask you to input personal details in order for us to identify you, such as your name, e-mail address, billing address, delivery address, credit card or other payment information. We confirm that this information will be held by us in accordance with the registration we have with the Data Commissioner's office.

Rx Express Service is authorised to save customers’ personal data and to use that data only in compliance with the provision of the Data Protection Act (Cap. 440)

Rx Express Service is entitled to disclose information about the customer to investigating authorities to the necessary extent, if the requesting authority submits proof that proceedings have been initiated against the customer for an administrative or criminal offence.

OFFERED SERVICES




Once you have uploaded your prescription/s, and order has been completed, upon validation of your order, you will be notified by a phone call (or by other means if an invalid number has been provided) that your order has been processed and has been despatched to your provided address. Payments for delivered medical products and all one-offs prescriptions will be collected upon delivery.

Once you have uploaded your prescription/s, and order has been completed, upon validating your order, you will be notified by a phone call (or by other means if an invalid number has been provided) that your order is ready for pickup, and must be collected within a timeframe as agreed between both parties. All one-offs prescriptions will be collected upon collection.

Once you have confirmed your request for a morning after pill (MAP), you will be notified by a phone call (or by other means if an invalid number has been provided) that your order has been processed and has been despatched to your provided address. Payments for delivered medical products and all one-offs prescriptions will be collected upon delivery.

Prior dispensing of the MAP, the pharmacist on duty will get in contact with you, and you will be asked about your last period and when you last had sex in order to make sure this medicine is suitable for you. EllaOne can be used at any point during your menstrual cycle, but not if your period is late. If your period is late, or your last period was more than five days late or unusually light or heavy, you may already be pregnant and this medicine will not work.

The Pharmacist reserves the right not to dispense such medication if deemed not fit for you. Upon dispensing, identification will be requested to prove that individual is 18+ years of age.

Pharmacy of Your Choice (POYC) – Free Entitled Medicines from the Government


At all of our pharmacies we do offer immediate POYC Service, however, should you be in a hurry and cannot wait, we can prepare your order for pickup, or if you wish to get your free entitled medicines delivered to your step, you can opt for a same day delivery.



If you are registered with one of the listed pharmacies on the Application, you can opt to have your free entitled medicine ready for pickup and therefore make the process even quicker.

If you are not yet registered, and you interested to register with one of our pharmacies call the respective pharmacy for more information.

You must upload a photo of:

  1. POYC scheme electronic card of paper-based patient voucher;
  2. Valid prescriptions;
  3. Entitlement card.

Make sure you present all documentation at the pharmacy. Prescriptions will be collected upon collection.



Pharmacy of Your Choice (POYC) – Free Entitled Medicines from the Government



If you are registered with one of the listed pharmacies on the App, you can opt to have your free entitled medicines delivered to your door step for a small charge. If you are not yet registered, and you interested to register with one of our pharmacies call the respective pharmacy for more information.


You must upload a photo of:

  1. POYC scheme electronic card of paper-based patient voucher;
  2. Valid prescriptions;
  3. Entitlement card.

THINGS YOU NEED TO KNOW ABOUT MEDICINES

MEdicines Authority


The Medicines Authority regulates medicinal products and pharmaceutical activities in Malta. It checks that medicines are safe and of good quality, monitors medicine advertising and those who dispense medicines.

NON-PRESCRIPTION AND PRESCRIPTION ONLY MEDICINES


In Malta, all medicinal products are dispensed only from pharmacies. The classification whether a medicinal product should be dispensed with or without a valid prescription is done as part of the Marketing Authorisation process . Through this process, the Medicines Authority ensures the quality, safety and efficacy of the medicinal product.

The legislation (Subsidiary Legislation 458.34) specifies that medicinal products shall be subject to medical prescription where they:

  1. are likely to present a danger either directly or indirectly, even when used correctly, if utilised without medical supervision, or
  2. are frequently and to a very wide extent used incorrectly, and as a result are likely to present a direct or indirect danger to human health, or
  3. contain substances or preparations thereof, the activity and/or adverse reactions of which require further investigation, or
  4. are normally prescribed by a doctor to be administered by injection.

Information on whether a specific product is prescription or non-prescription medicine is available on the Search for Medicines facility .


What is a one-off prescription?

A one-off prescription is issued by a healthcare professional such as a dentist or a doctor to treat a specific medical condition with medicine for a short period of time. For example, this might be an antibiotic to treat an infection, or a painkiller to help with pain from an injury.

You can order these medicines by uploading and sending us your prescription after you have signed up to use the Rx Express Service Application, or by visiting one of our pharmacies.


What is a repeat prescription?

A repeat prescription is issued by a prescribing healthcare professional like a doctor, usually for medical conditions which need to be treated for a long period of time. This includes long-term conditions like diabetes. Your prescriber may allow you to request another prescription without having to see them each time you need more medicine. They do this by authorising repeated supplies of the medicine over a specific time period, until a set review date.

Validity of Prescriptions

Prescriptions are valid for six months from date in which it is written, except for antibiotics where a prescription cannot be dispensed after 10 days of its issue date.



Prescription for psychotropic substances and narcotic drugs

Prescription for psychotropic substances and narcotic drugs (green prescriptions) cannot be repeated, thus are to be dispensed only once. Green prescriptions are to be accompanied by a control card which is issued by the Drug Control Unit . In urgent cases, when the control card for green prescriptions is not available, an urgent prescription may be prescribed by the medical practitioner, against which a maximum of one week supply of medicine can be dispensed.



‘Same Day Delivery Service’ is NOT available for GREEN PRESCRIPTIONS. Psychotropic substances and narcotic drugs are to be collected ONLY at a pharmacy.



PHARMACY OF YOUR CHOICE


The Pharmacy Of Your Choice Scheme (POYC) is a service facilitating access to the national pharmaceutical care service through collaboration with community pharmacies. Those entitled to pharmaceutical items can apply at a pharmacy they choose to collect medicines from there.

MEDICINES ENTITLEMENT


If you are suffering from a chronic condition such as a malignant, cardiovascular, respiratory or digestive system disease, you are entitled to free medicines from the Government. You will be referred to a Consultant from the Government Health Service who will apply for a Schedule V Card with a list of the free medicines you are entitled to.


PROTECTING YOUR SECURITY

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases.

We take the risk of internet fraud very seriously. With the volume of fraudulent credit card transactions increasing, we make every effort to ensure all orders are thoroughly checked using the information already supplied. We will not tolerate fraudulent transactions and such transactions will be reported to the relevant authorities.


COMPLIANCE

The Service may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Service and its use.

You agree not to:

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Application will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of- service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Application or to your downloading of any material posted on it, or on any website linked to it.

ORDERS

All requested services are subject to acceptance and current availability of medicinal product. If the medicinal products requested on prescription are not available, you will be notified by a phone call (or by other means if an invalid number has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order.

Any orders placed by you will be treated as an offer to purchase the services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase a service advertised on the Application. The conclusion of a contract between you and us will take place when we dispatch the goods to you or commence the services, whichever is the later, at which time we shall give you a phone call and confirming that the contract has been concluded ('Ready for Pickup during Opening Hours, Ready for Pickup during Closing Hours, Order Despatched').

We will not be obliged to supply any other goods or services which may have been part of your order until the dispatch of such goods or services has been confirmed in a separate Dispatch Confirmation.

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be liable for any loss you may suffer if a third party procures unauthorised access to any data provided by you when accessing or ordering from the Service.

You will assume the risk for the products once they have been delivered to the delivery address which you specified when ordering the products. We accept no liability where you provide an incorrect delivery address or where you fail to collect the products from the pharmacy which you specified.


CANCELLATION RIGHTS & Refunds

Where you have purchased a service as a consumer, please note that you are entitled to cancel any contract completed with us, however all services fees paid for Emergency Pickup during closing hours and Same Day Delivery, are non-refundable.

RETURNS POLICY

Due to legal restrictions, non-prescription and prescription medications cannot be returned to pharmacies.

You cannot return any unwanted medicinal products for a refund or replacement. We are not able to exchange products.


PRICE AND PAYMENT

All prices shown on the Application are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. We reserve the right, however, to change prices at any time without notice to you.


Three (3) Euro charge applies for all orders below Forty (40) Euro worth of goods.

INTELLECTUAL PROPERTY

The content of the Application is protected by copyright, trade marks, database and other intellectual property rights and you acknowledge that the material and content supplied as part of the Application shall remain with us or our licensors.

You may retrieve and display the content of the Application on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Application.


USE OF ‘Rx Express Service’

The Application is provided on an 'as is' and 'as available' basis without any representation or endorsement made and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the Application and any information provided by you. You must bear the risk associated with the use of the Internet.

Whilst we will try to ensure that material included on the Application is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Application. If we are informed of any inaccuracies in the material on the Application we will attempt to correct this as soon as we reasonably can.

In particular, we disclaim all liabilities in connection with the following:

To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (both of which terms includes, without limitation, pure economic loss, loss of profits, loss of business, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to your use of the Application.

SEVERANCE


If any part of the Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions of the Terms.

WAIVER


No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

ENTIRE AGREEMENT


These Terms form the entire basis of any agreement reached between you and us.

LAW AND JURISDICTION


These Terms shall be governed by and construed in accordance with the laws of the Republic of Malta and any disputes will be decided only by the Maltese courts.

We will not be obliged to supply any other goods or services which may have been part of your order until the dispatch of such goods or services has been confirmed in a separate Dispatch Confirmation.


We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be liable for any loss you may suffer if a third party procures unauthorised access to any data provided by you when accessing or ordering from the Service.


You will assume the risk for the products once they have been delivered to the delivery address which you specified when ordering the products. We accept no liability where you provide an incorrect delivery address or where you fail to collect the products from the pharmacy which you specified.



CANCELLATION RIGHTS & Refunds

You cannot return any unwanted medicinal products for a refund or replacement. We are not able to exchange products.

Payments can be made in cash or by any major credit or debit card at the pharmacy upon collection for EMERGENCY PICKUPS and solely in cash for SAME DAY DELIVERY.

The content of the Application is protected by copyright, trade marks, database and other intellectual property rights and you acknowledge that the material and content supplied as part of the Application shall remain with us or our licensors.


You may retrieve and display the content of the Application on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Application.

The Application is provided on an 'as is' and 'as available' basis without any representation or endorsement made and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the Application and any information provided by you. You must bear the risk associated with the use of the Internet.


Whilst we will try to ensure that material included on the Application is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Application. If we are informed of any inaccuracies in the material on the Application we will attempt to correct this as soon as we reasonably can.


In particular, we disclaim all liabilities in connection with the following:
